Your contract with Safricatours:
Definitions:
In this contract the words you, your, customer and client/s means the person signed the booking form and all the other members in the booking form, we, us, our and company means Safricatours of P.O Box 10168, Caledon Square, 7905, CAPE TOWN, South Africa. Your contract with us is in existence once you complete and sign our booking form and forward to us together with the appropriate deposit per person. This contract is made under the terms of these booking conditions, which are governed by South African law. Both parties agree to the jurisdiction of the South African courts at all times.

 

  1. Booking your holiday:
    A deposit of 50% of the booking value is payable at the time of reservation, when you must read our terms and conditions, complete and sign our booking form. Confirmation of the booking and payment of the deposit shall constitute acceptance of our terms and conditions. We must receive full payment no later than 8 weeks prior to departure date. In the event that the booking is made less than 30 (thirty) days prior to departure, full payment must be made on confirmation of booking and is non-refundable. If the payment is not received by due date in which event, any deposit paid will be forfeited to the company. The company reserves the right to cancel the booking and apply cancellation charges as set out in clause 5.
    SPECIAL REQUESTS should be made at the time of booking. We will arrange for the special requests to be met but these cannot be guaranteed and the Company is not liable if any special request is not met.
  2. Price Guarantee:
    Whilst we reserve the right to increase or decrease prices – the price shown in the confirmation is fully guaranteed and will not be subject to any changes or surcharges unless you decide to change or alter your confirmed booking, the cancellation or alteration charges will apply. Action by government and other regulatory authorities to impose customer levies or any changes to existing charges, taxes, exchange rates, transportation costs, including cost of fuel, dues, fees chargeable for services such as embarkation or disembarkation taxes at airports and ports in Southern Africa, these are excluded from our price guarantee.
  3. General Conditions:
    Your travel agent through whom you book your holiday will act as an information link between Safricatours and you. We accept no responsibility for any failure by your travel agent to do this properly, or in good time nor any advice given to you by your travel agent, which do not originate from us. All monies paid to your travel agent for our booking are held by the agent on your behalf until it is paid to us and we issue a confirmation invoice and, thereafter, the travel agent hold the money on our behalf. If your booking is made through a travel agent, all communications by us will be made to the travel agent. If the booking is made directly with us, all correspondence will be forwarded to the leader of the party unless otherwise stated.
  4. Cancellation by you:
    Should you or any member of the party wishes to cancel all or any part of your confirmed booking or that the booking is cancelled by us due to failure by you to pay amount due, the following charges will apply:

    NB: In the event of customer cancelling the reservation for any reason, such cancellation must be made in writing to us. No refunds will be made for no-shows or any unused services. The cancellation will take effect from the day your written notification, signed by the same person who signed the booking form is received by us. Cancellation charges for private game reserves, train journeys, peak periods, tours and group bookings differ and will be advised at the time of booking. We strongly recommend that you take out full insurance, which will in most cases cover against loss of deposit or cancellation charges.
  6. Alterations by you:
    Should you wish to alter your confirmed booking, you must inform us in writing, signed by the same person who signed the booking form, and we will do our best to implement changes. Amendment fee of R120, plus communication charges will apply. If notice of amendments is received within 43 days prior to departure, the cancellation charges as above will apply. In the event of you altering your holiday after it has commenced, this is your own responsibility. We are not responsible for any changes or difficulties that may arise as a result of such alterations. No credit or refund for any unused services in the cost of your holiday will be given. Name changes caused by exceptional circumstances with evidence by suitable documentation can be accepted up to four weeks of departure. Changes involving schedule airlines are normally regarded as cancellation and re-booking. Such changes are, however, subject to availability and any additional charges by the airline.
  7. Cancellation by us:
    We will not cancel your holiday within 8 weeks of your departure unless the cancellation is caused by Force Majeure as set out in clause 8 or unless you have not paid the final balance due. In the unlikely event that we have to cancel your booking (provided that the cancellation has not been caused by Force Majeure) we will offer you alternative arrangements. If these new arrangements are not acceptable we will refund all monies paid to us.
  8. Force Majeure:
    We cannot accept any responsibility or pay any compensation where the performance or prompt performance of our contractual obligation is prevented or affected by reasons of ‘force majeure’ i.e. war, riot, civil unrest, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, technical problems with transport, closure or congestion of airports, cancellation of schedules by airlines. We accept no responsibility for and shall not be liable in respect of loss or damage, alterations, delays arising from unusual and unforeseeable circumstances beyond our control. All expenses incurred by such events, including but not limited to unscheduled extensions, or curtailment of accommodation, changes to schedule flights, additional expenses will be for the customer’s account.
  9. Alteration by us:
    If, in the Company’s discretion, the fulfilment of any tour is considered impossible, illegal or inadvisable or any other adverse factors beyond our control, the company reserve the right to cancel a tour or make alterations to the route, price and/or any other aspect thereof as it deems fit. Should it be necessary for us to make a significant change to your confirmed booking (provided that the change has not been caused by Force Majeure, we will advise you or your Travel Agent as soon as reasonably possible and you will have a choice of either accepting the alternative arrangements or cancelling your holiday with full refund of all monies paid to us.
  10. Exclusion of Liability:
    The Company makes every effort to engage quality suppliers (e.g. airlines, hotels and other service providers) to provide the travel products featured and always make sure that the various services will be carried out efficiently and as specified. However, the company does not have direct control over the provision of services by suppliers and shall not accept liability for any loss, damage, injury, additional cost, accident, delay, error or default, act or omission of any supplier in carrying out the arrangements of any tour, or otherwise in connection therewith. We apply all reasonable checks to ensure that all those involve in the preparation and provision of your holiday maintain appropriate standards. The descriptions, information and our opinion in your booking by us in respect of all suppliers whose services are used are given in good faith, based on the latest information at the time of print. We strive to ensure accuracy of information provided, however, we are not always able to control all components of holiday arrangements and advertised facilities may be withdrawn or changed. Safricatours, servants, and their agents shall not be responsible for and shall be exempt from all liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person, or his or her luggage or other personal property, whatever the same shall occur and whether the same shall arise from or occasioned by the negligence of Safricatours, their servants or agents or other persons directly or indirectly in the employment of service of our company or otherwise under any circumstances whatsoever. If any client suffers death, illness or personal injury arising out of the inclusive holiday arrangements or excursions arranged through us, we shall offer assistance in the form of guidance and advice.
  11. Complaints procedure:
    If you have a problem or complaint during your holiday, you must report it immediately and directly to the relevant supplier e.g. hotel manager who will endeavour to rectify the problem. Most problems can be sorted out straight away, however, if your problem cannot be resolved locally, and you wish to complain, full details of the complaint must be received by us within 28 days of return home. Please note that it is a condition of this contract that you communicate any problem or complaint directly to the supplier in question whilst on holiday. Failure to follow this simple procedure will affect your rights under this contract as we have been deprived of the opportunity to investigate and rectify the problem
  12. Your responsibility:
    It is the responsibility of the client to be in possession of valid, travel documents, passport, visa, International Driving Licence, health requirements (vaccinations/inoculations), permits and other travel documents required for the holiday. Customers will be personally responsible for ensuring that they are in possession of the required documentation prior to their departure. It is a client’s responsibility to arrive at stated departure times and point and any loss or damage which you suffer through failure to do so lies with you, the Company accepts no responsibilities whatsoever through your failure to comply with stipulated rules. If the behaviour of any member of the party is considered likely to cause danger, offence, damage or stress to others, the company reserves the right to cancel your holiday and apply cancellation charges and if any of our suppliers consider that your behaviour is unacceptable, they are authorised to terminate a holiday wherever and whenever necessary. Should this situation arises, we will not be liable to cover any expenses incurred by the party concerned and neither consider any claims for compensation or refunds.
  13. Prices:
    All prices and rates are subject to change without prior notice and are quoted in South African currency (Rands), unless otherwise specifically agreed. Payment in approved foreign currency will be accepted at the rate of exchange applied by our bank at the time of receipt of payment. Any shortfall due to exchange rate fluctuations will be for the customer’s account.Payments are made via EFT or Direct Deposit into our bank account details of which will be on our invoice to you.
  14. Third Party links In an attempt to provide increased value to our Users, we may provide links to other websites or resources. You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content( including misrepresentative or defamatory content) of such websites, including ( without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by,or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources.

Please note: Anti-malaria precautions are strongly recommended when visiting Eastern Lowveld of Mpumalanga and Northern Province, the Kruger National Park and the game reserves in KwaZulu-Natal. Please check an up to date health requirements with your doctor or pharmacist. It is a client’s responsibility to arrive at stated departure times and any loss or damage which you suffer through failure to do so lies with you, the Company accepts no liability whatsoever through your failure to comply with stipulated rules.
